Operation Linda Jamii In Court To Challenge Appointment Of Musalia Mudavadi

Operation Linda Jamii has filed a Petition at the High Court challenging what they call “the President’s unconstitutional exercise of state authority in the creation and appointment of Musalia Mudavadi as the Prime Cabinet Secretary, whose functions as spelt out in the Executive Order No. 1 of 2023 altering the Basic Structure of the Constitution contrary to the law.”

The Petition also challenges the President’s cabinet-level appointments of Harriette Chiggai as the CS President’s Women rights advisor and Monica Kathina Juma CS President’s National Security advisor positions which the lobby group claimed are not contemplated in the constitution and which are thus “unlawful, illegal and unconstitutional.”

The petitioners also challenges the entire constitutive composition of the cabinet of the Republic of Kenya for failing to comply with the constitutional dictates on gender balance, inclusion of persons living with disability and the youth.

The Petitioner pleads that with the representation of the composition of the cabinet and the President and Deputy President who are all male, the cabinet as presently constituted fails to comply with the constitutional gender principle that not more than two-thirds of elective and appointive bodies should comprise of the same gender.

The Petitioner pleads further that cabinet as presently constituted does not comprise of at least 5% of persons living with disabilities thus violative of the constitution and principles of affirmative action entrenched in the constitution.

“The foregoing notwithstanding, the creation of the office of the Prime Cabinet Secretary to assist the President and the Deputy President in the day-to-day running of the government is akin to creating a second office of the Deputy President, who by law is the ONLY assistant to the President.” reads court documents.

Consequently, the Petitioner avers that the creation of the Office of the Prime Cabinet Secretary is unconstitutional, illegal and unlawful since the creation of the said office is tantamount to amending and/or altering the basic structure of the executive arm of the government by creating two principal assistants to the President in violation of Article 147(1) of the Constitution.

Man Risks Death Sentence For Violent Robbery

A middle-aged man risks a death sentence after being accused of robbery with violence.

Waren Siago Mwimbi may find himself serving a life sentence if convicted to a robbery with violence case which he was charged with in a Nairobi Court.

The suspect, Waren Siago is accused of stealing a Samsung Z phone valued at Ksh 250,000.

According to the charge sheet, the suspect on July 28, 2023, at Runda Westland Sub-County within Nairobi, jointly with another person yet to be arrested, attacked John Mwangi Kamau, a resident at Runda Estate and robbed him of the said phone valued at Sh 250,000.

Appearing before Principal Magistrate Benmark Ekhubi, the suspect denied the charges and was released on a bond of Ksh 200,000 with an alternative cash bail of Ksh 150,000.

According to sections 295 and 296 of the Penal Code, anybody who uses or threatens to use violence during a robbery is liable to an offence of robbery with violence which is punishable by death or lifetime imprisonment.

The Penal Code, Section 296 (2) sets out the elements of robbery. To qualify as robbery with violence, the evidence of the theft, the number of assailants, whether the appellant was armed with a dangerous weapon, and whether the appellant beat the complainant has to be determined.

The case proceeds on August 30, for pretrial.

Microplastics Found In Human Hearts For The First Time, New Study Finds

In a groundbreaking discovery, a Chinese research team from Beijing Anzhen Hospital has uncovered a concerning link between microplastics and human health.

The study, which marks the first instance of microplastics being detected in the human heart, raises significant questions about the pervasive nature of these synthetic particles.

The research team focused on 15 patients who had undergone heart surgery, meticulously analyzing their heart tissues for the presence of microplastics – minuscule particles measuring less than 5mm.

The study aimed to investigate the potential pathways through which these particles could infiltrate the cardiovascular system.

The findings were striking. The researchers identified a multitude of microplastic fragments in the majority of heart tissue samples, a discovery that sent ripples through the scientific community. To delve further, blood samples were collected from half of the patients, revealing the presence of plastic particles in all samples.

The study revealed the existence of nine distinct types of plastic across five categories of heart tissue, including poly(methyl methacrylate), a plastic often used as a glass substitute.

Perhaps most concerning, the research hinted that these microplastics weren’t solely introduced during surgical procedures, but could also have unintentionally entered the patients’ bodies through other means.

This discovery underscores the urgency of comprehending the far-reaching consequences of plastic pollution on human health.

KAM Advices Kenyan Workforce To Align Their Skills With Industry Demands

On Friday, more than 127 trainees who were chosen from a variety of KAM Membership organisations were honoured for their involvement in training initiatives.

These training sessions focused on teaching knowledge through skill growth, skill improvement, and skill transformation.

The three main areas of attention in the training were improving the ability of machine operators with numerous talents, training machine mechanics operators, and improving supervisory abilities for mid-level management.

The event was honoured by the presence of His Excellency Maarten Brouwer, the Ambassador of the Kingdom of the Netherlands in Kenya.

Abel Kamau, the Trade Policy Manager for KAM and the KAM Chief Executive, emphasised the critical necessity of matching the skill sets of the Kenyan workforce with the needs of industry during the occasion.

Additionally, he emphasised that businesses saw increased productivity in project participants as their abilities developed.

The IDH’s programme manager, Ms. Caroline Ngumba, emphasised the industry’s enormous growth potential in the textile and leather fields. She emphasised the significance of addressing sustainability issues, especially factors relating to social issues like training for employees’ capacity-building, which would positively influence growth.

Ambassador Maarten Brouwer stressed the importance of combining innovation, knowledge, and financial backing to generate practical solutions during his keynote speech.

In order to close the industry’s training shortages, he further emphasised the significance of public and private sector cooperation.

Hawaii Fire Death Toll Nears 100, And Anger Grows

The death toll in Hawaii from the deadliest US wildfire in more than a century ticked towards 100 Sunday, fueling criticism that government inaction contributed to the heavy loss of life.

At least 96 people were confirmed to have died as of Sunday night, but officials warned the figure was likely to rise as recovery crews with cadaver dogs work their way through hundreds of homes and burned-out vehicles in Lahaina.

The historic coastal town on the island of Maui was almost destroyed by the fast-moving inferno early Wednesday morning, with survivors saying there had been no warnings.

When asked Sunday why none of the island’s sirens had been activated, Hawaii Senator Mazie Hirono said she would wait for the results of an investigation announced by the state’s attorney general.

“I’m not going to make any excuses for this tragedy,” Hirono, a Democrat, told CNN’s “State of the Union.”

“We are really focused, as far as I’m concerned, on the need for rescue, and, sadly, the location of more bodies.”

More than 2,200 buildings were damaged or destroyed as the fire tore through Lahaina, according to official estimates, wreaking $5.5 billion in damage and leaving thousands homeless.

“The remains we’re finding are from a fire that melted metal,” said Maui Police Chief John Pelletier. “When we pick up the remains… they fall apart.”

That was making identification difficult, he added, appealing for those with missing relatives to give DNA samples that might speed up the process.

Pelletier said cadaver dogs still had a vast area to search in the hunt for what could still be hundreds of people who are unaccounted for.

“We’re going as fast as we can. But just so you know, three percent — that’s what’s been searched with the dogs,” he said.

– Questions over alert system –

The wildfire is the deadliest in the United States since 1918, when 453 people died in Minnesota and Wisconsin, according to nonprofit research group the National Fire Protection Association.

The death toll surpassed 2018’s Camp Fire in California, which virtually wiped the small town of Paradise off the map and killed 86 people.

Questions are being asked about how prepared authorities were for the catastrophe, despite the islands’ exposure to natural hazards such as tsunamis, earthquakes and violent storms.

In its emergency management plan last year, the State of Hawaii described the risk wildfires posed to people as being “low.”

Yet the layers of warning that are intended to buffer a citizenry if disaster strikes appear not to have operated.

Maui suffered numerous power outages during the crisis, preventing many residents from receiving emergency alerts on their cell phones.

No emergency sirens sounded and many Lahaina residents spoke of learning about the blaze from neighbors running down the street or seeing it for themselves.

“The mountain behind us caught on fire and nobody told us jack,” resident Vilma Reed, 63, told AFP.

“You know when we found that there was a fire? When it was across the street from us.”

Reed, whose house was destroyed by the blaze, said she was dependent on handouts and the kindness of strangers, and was sleeping in a car with her daughter, grandson and two cats.

The New York Times reported Sunday that firefighters sent to tackle the flames found some hydrants had run dry.

“There was just no water in the hydrants,” the paper quoted firefighter Keahi Ho as saying.

– Roadblocks –

The congregation of Grace Baptist Church, which was leveled in the blaze, gathered Sunday in a coffee shop in Kahului for two hours of solace.

Pastor Arza Brown led the service in his sandals, the only shoes that survived the blaze that destroyed his house.

But the trappings of ministry were far from his mind as he comforted fellow evacuees.

“That’s one thing about getting together today — just to be with each other and encourage each other,” he said.

For some survivors, the difficult days after the tragedy were being worsened by what they see as official intransigence, with roadblocks preventing them from getting back to their homes.

Maui police said the public would not be allowed into Lahaina while safety assessments and searches were ongoing — even some of those who could prove they lived there.

Maui’s fires follow other extreme weather events in North America this summer, with record-breaking wildfires still burning across Canada and a major heat wave baking the US southwest.

Europe and parts of Asia have also endured soaring temperatures, with major fires and floods wreaking havoc. Scientists say human-caused global warming is exacerbating natural hazards, making them both more likely and more deadly.

New British High Commissioner Neil Wigan Arrives To Assume Office

The new British High Commissioner to Kenya Neil Wigan on Monday arrived in Nairobi to take up his position as Head of Mission at the British High Commission.

Speaking on his arrival, the new British High Commissioner to Kenya, he expressed his joy noting that his children went to school in the Capital.

“I first visited Kenya in 1977, my children went to school in Nairobi, and I have visited Kenya many times, for work and pleasure. I am delighted to have returned and am looking forward to exploring magical Kenya,” Wigan said.

“I look forward to working with the Government of Kenya on the priorities of our Strategic Partnership, particularly the Sh500 billion of UK investment in clean, green infrastructure projects including Nairobi Railway City, Menengai Geothermal Plant, Grand High Falls Dam and the Malindi Solar Expansion project.”

Wigan was appointed British High Commissioner to Kenya in April. He succeeds Jane Marriott who was transferred to another Diplomatic Service appointment.

The United Kingdom government said Wigan would take up his appointment in July.

Prior to his appointment, Wigan was Tel Aviv Ambassador since 2019.

He has also served as a UK Ambassador to Kinshasa and Mogadishu as well as FCO Director of Africa.

Jane Marriott has been British High Commissioner to Kenya since September 2019.

Prior to taking up the position, she was Director of the UK’s Joint International Counter-Terrorism Unit. In that role, she had responsibility for the overall design of the UK’s international counter-terrorism strategies, working with cross-Government and international stakeholders.

African Union Security Council Meets On Niger Crisis

The African Union (AU) said it was holding a meeting on Monday on the crisis in Niger following the coup on July 26 that toppled President Mohamed Bazoum.

“AU’s Peace & Security Council meets to receive an update on the evolution of the situation in Niger and the efforts to address it,” the pan-African body said in a post on X, formerly known as Twitter.

The meeting was taking place at AU headquarters in the Ethiopian capital Addis Ababa, it said.

Those attending include AU Commission chief Moussa Faki Mahamat as well as representatives from Niger and the West African bloc ECOWAS.

Last week, Faki expressed “deep concern” at the reported poor conditions of Bazoum’s detention, calling his treatment at the hands of coup leaders “unacceptable.”

On Sunday, Niger’s military regime vowed to prosecute the democratically elected Bazoum for “high treason” and slammed ECOWAS for imposing sanctions on the country.

Bazoum, 63, and his family have been held at the president’s official Niamey residence since the coup.

KRA Auctions Overstayed Cars, Furniture At Mombasa Port

The Kenya Revenue Authority (KRA) is carrying out a mass auction of imported vehicles and other items that have overstayed at the Mombasa port.

KRA on Monday, August 14, 2023, announced the mass auction while inviting prospective bidders to check out the items on sale through a dedicated portal.

The taxman said the auction runs from Monday, August 14, 2023, to Sunday, August 20, 2023.

“KRA is running an Online Auction to sell overstayed cargo at the Port of Mombasa. The Auction is running from Monday 14th August 2023 to Sunday 20th August 2023,” KRA announced.

The taxman further explained that to place bid(s) in the portal one had to log in using their KRA iTax PIN and iTax Password.

KRA also notified bidders that the bidding prices are final and would not be subjected to taxation.

“Kindly note that the bidding price is final and no taxation will be done. However, the registration with NTSA will be done after you win the bid at your own expense,” KRA said.
