Will Kenya Be The Latest Country To Pass Anti-Gay Law?

In the latest sign of rising homophobia in different African countries, a Kenyan opposition MP is leading a campaign for parliament to further criminalise the country’s small LGBTQ community.

George Peter Kaluma’s move comes after neighbouring Uganda adopted a tough new anti-gay law, rejecting threats by US President Joe Biden to impose sanctions and travel restrictions on “anyone involved in serious human rights abuses”.

When I met Mr Kaluma – a member of veteran Kenyan opposition politician Raila Odinga’s Orange Democratic Movement – he was sitting behind his desk at his office in the capital Nairobi, proof-reading and making corrections to a bill that he intends to table in parliament soon.

“We want to prohibit everything to do with homosexuality,” Mr Kaluma tells me, adding that his bill will be much broader than the legislation passed by Uganda’s parliament and approved by President Yoweri Museveni in May.

The Ugandan law is regarded as one of the harshest anti-LGBTQ laws in the world.

It proposes life imprisonment for anyone convicted of homosexuality, and the death penalty for so-called aggravated cases, which include having gay sex with someone below the age of 18 or where someone becomes infected with a life-long illness such as HIV.

On the other side of the continent, MPs in Ghana earlier this month unanimously voted in favour of amendments to the country’s anti-gay legislation, pushing it closer to being enacted into law. Though less harsh than Uganda’s new law, the Promotion of Proper Human Sexual Rights and Ghanaian Family Values Bill proposes a three-year prison sentence for anyone who identifies as LGBTQ and a 10-year sentence for anyone who promotes homosexuality.

So why are different African countries proposing anti-LGBTQ measures at the same time? Some think that US evangelical groups may be playing a role by pushing their agenda on the continent.

In a trip that Mr Kaluma says was paid for by Kenya’s parliament, he attended a meeting of the newly created African Interparliamentary Forum on Family Values and Sovereignty held in Uganda in March.

Lawmakers, religious leaders and campaigners from more than 20 African states participated, sharing ideas on how to tackle what they see as threats to conservative religious and social values.

“The bill will propose a total ban on what the West calls sex-reassignment prescriptions and procedures, and prohibit all activities that promote homosexuality, in terms of… gay parades, drag shows, wearing the colours, the flags, the emblems of the LGBTQ group,” Mr Kaluma says.

Gay sex is already illegal in Kenya, but the government can also be tolerant of gay people – for example, it has given asylum to people from other African countries, including Uganda, who faced persecution in their home countries because of their sexual orientation.

Mr Kaluma tells me he wants their asylum to be revoked, and for them to leave Kenya.

At a small, hidden church set up to offer comfort and support to LGBTQ people in central Nairobi, the female pastor says Mr Kaluma’s bill is causing “a lot of panic, anxiety, fear”. The pastor and members of the church ask that we keep them anonymous because they say they have faced numerous security threats since it was established about 10 years ago.

She believes the proposed legislation will increase violence against them. “It gives power to anybody that would want to do something to the queers. It fuels some kind of violence that now people are planning but holding back on,” she tells me.

Although the meeting in Uganda was billed as an attempt to protect the “sovereignty” of African states, it was actually co-sponsored by an American Christian right-wing organisation, Family Watch International (FWI).

Dr Kapya Kaoma, a Zambian priest in the Anglican Church and an academic at Boston University in the US, says African countries are being targeted by FWI and similar US-based organisations, and that the impact of its lobbying has been “horrible and inhumane” in parts of Africa, fuelling what he calls “militant homophobia”.

“It is one thing to say: ‘I don’t agree with you being gay’, but we didn’t have the militant one, where politicians now are saying: ‘You go to jail for life, you go to jail for talking about being gay, you go to jail because you’re living with your fellow woman’,” Dr Kaoma says.

FWI’s Mormon founder Sharon Slater denies that the group promotes anti-gay laws in Africa.

“Family Watch opposes legislation that penalises a person for having sexual attractions or for how they identify,” she says in an emailed response to the BBC.

Mrs Slater addressed African lawmakers, clerics and campaigners at their forum in Uganda’s lakeside city of Entebbe in March, and later appeared in a group photo with President Museveni at his official residence.

For more than 20 years, Mrs Slater has lobbied governments on what she calls “family values” and has made it her mission to campaign against children and young people being given Comprehensive Sexuality Education (CSE), a curriculum-based sex education programme championed by the United Nations and other organisations.

She cites a United Nations Population Fund (UNFPA) manual for out-of-school youths in east and southern Africa, saying it promotes homosexuality and is too explicit.

“It desensitises children to sex,” she says.

Mrs Slater also quotes from the manual, including lines which say that facilitators of lessons should have “a neutral, accepting attitude towards homosexuality”.

When I contact Maria Bakaroudis, UNFPA’s CSE specialist for east and southern Africa, for comment, she says she is not keen to talk about the “opposition”, as she refers to FWI.

She adds that the manual is only a guideline, and each country can tailor it to suit their context.

Ms Bakaroudis defends CSE, saying it provides “life-saving information” to curb high rates of unintended pregnancies, HIV, and sexually transmitted diseases.

Although Mr Kaluma attended the meeting in Uganda co-sponsored by FWI, he denies working with the group on his bill, which he says will propose a ban on teaching CSE saying it is part of the “LGBTQ agenda”.

“It’s being pushed by the West very hard, including in Kenya. We will be banning it completely in the bill, to allow us to have sex education, which is age, developmental, and culturally appropriate in our context,” he says.

Mr Kaluma argues that the “LGBTQ agenda” has become a “big industry, especially in the West” and, despite opposition to it from some of their own citizens, Western governments want to promote it in Africa.

The majority leader in Kenya’s lower parliamentary chamber, Kimani Ichung’wah, tells the BBC that the ruling Kenya Kwanza alliance does not have a position on Mr Kaluma’s proposed legislation but it will give its MPs a free vote if it is tabled.

Kenya’s President William Ruto has not commented on Mr Kaluma’s plans, but said earlier this year that “our culture and religion does not allow same-sex marriages”.

Mr Kaluma is confident that the bill will become law, raising deep concern in Kenya’s LGBTQ community.

Some of the dozen or so people at the Nairobi church tell me that Mr Kaluma’s proposals are not just part of a political debate, but go to the core of their fight, simply to exist.

“I can’t reverse what I am. This is me. We are also human beings. We do our work. We pay the bills. We pay taxes, so they have to accept us,” one transgender woman says.

EFL Approves Leeds Takeover By 49ers Enterprises

Leeds United are now owned by 49ers Enterprises after the English Football League formally approved their £170m takeover of the Championship club.

The investment arm of the San Francisco 49ers purchased a 15% stake in Leeds in 2018 and increased that to 44% in 2021.

They now have full control after announcing the purchase of Andrea Radrizzani’s share.

“This transition is a necessary reset to chart a new course for the club,” said new chairman Paraag Marathe.

“This is an important moment for Leeds United and we are already hard at work. We are confident Leeds will field a competitive squad to contend for promotion next season.”

Leeds also confirmed that existing chief executive Angus Kinnear will remain in his current position while entrepreneur Rudy Cline-Thomas, founder and managing partner of venture capital firm Mastry, will join the board as co-owner and vice chairman.

“49ers Enterprises is bringing fresh leadership, management and a commitment to investment, which I’m confident will meet our ambition to compete for promotion and remain in the top flight as an established Premier League Club,” Kinnear said.

“I know Paraag, Rudy and 49ers Enterprises will keep supporters central to their plans during their custodianship and I am excited to work in realising the true potential of this great club.”

Cline-Thomas added: “With my family hailing from Leeds, it’s an honour to be able to uplift this incredible community. This is more than just an opportunity, it’s a personal mission.

“The chance to reinvigorate the cherished Leeds culture, to create a platform that attracts the world’s finest players and build a truly global brand that celebrates diversity is a prospect that thrills me.”

‘They will take Leeds to the next level’

Radrizzani bought Leeds outright for £45m in 2017 but his stake had reduced to 56% by the time he sold up and claimed that the new custodians would move the club forward.

“It has been an honour to guide Leeds United over the last six years and to spend so much time with the best fanbase in the world,” the 48-year-old said.

“49ers Enterprises have been fantastic partners for years and I’m confident they will take Leeds to the next level.”

Radrizzani had initially been popular with Leeds fans, with manager Marcelo Bielsa taking them back into the Premier League.

But the relationship soured after he sacked the Argentine and he did not attend their final game of last season, a defeat by Tottenham which sealed their relegation while fans chanted for him to leave.

After relegation was confirmed, the Leeds United Supporters Club released a statement saying Radrizzani was “no longer an appropriate person to own Leeds United”.

“His behaviour is appalling and he risks never being welcome at our club again,” it added.”The sooner he goes the better and we look forward to the 49ers Enterprises offer being accepted. The only way he can begin to salvage his reputation is through an immediate sale of the club and the stadium.”

Radrizzani’s Aser Holding Company recently bought a stake in Italian side Sampdoria.

Djokovic Fined For Smashing Racquet In Final Loss

Novak Djokovic has been fined £6,117 for smashing his racquet against the net post during the Wimbledon men’s singles final.

The incident occurred in the fifth set of his loss to Spain’s Carlos Alcaraz when the 36-year-old Serb’s serve was broken in the third game.

Umpire Fergus Murphy immediately issued Djokovic a warning for a code violation for the transgression.

The money will be deducted from his runner-up cheque of £1.175m.

Djokovic’s frustration had built up in the decisive set of an enthralling contest on Sunday, having missed a simple chance at the net for a break to go 2-0 up.

In the very next game Alcaraz backed up the hold by breaking the serve of the seven-time Wimbledon champion, which prompted the emotional outburst from Djokovic and brought boos from a section of the Centre Court crowd.

World number one Alcaraz took full advantage of the break to seal a 1-6 7-6 (8-6) 6-1 3-6 6-4 victory after four hours and 42 minutes.

The 20-year-old’s victory at the All England Club denied Djokovic a 24th grand slam title.

Lille Sign Iceland Midfielder Haraldsson On Five-Year Deal

Lille have signed Iceland midfielder Hakon Haraldsson from FC Copenhagen on a contract until 2028, the Ligue 1 club said on Monday.

The two sides did not reveal the transfer fee but both Danish and French media reported that Lille had paid Copenhagen 17 million euros ($19.11 million) for the 20-year-old.

“The battle was hard and long but with Hakon’s decisive support and determination, it is now done,” Lille President Olivier Letang told the club website.

“He is a player who was the subject of many requests in Europe and his profile allows him to play in different attacking positions. We will now be able to integrate him into the LOSC family so that he adapts to France and Ligue 1.”

Haraldsson joined Copenhagen as a 16-year-old from Icelandic side IA Akranes in 2019 and has made nearly 60 appearances in all competitions, including six in the Champions League, since his first-team debut in 2021.

He helped Copenhagen to win two Danish Superliga titles in the two recent campaigns, also winning the Danish Cup in 2022-23.

“Hakon has gone from a young talent to a top player and therefore it is logical that the interest in him has been great,” said Copenhagen sporting director Peter Christiansen.

Haraldsson, whose parents are former national team players, made his Iceland debut in June 2022 in a friendly 2-2 draw against Israel. Since then he has earned 10 more caps and scored one goal.

Willian Staying Another Season At Fulham

Veteran Brazilian international Willian on Monday re-signed for Fulham on a one-year deal with an option for a further 12 months.

The 34-year-old former Chelsea and Arsenal winger scored five times in 27 Premier League appearances for the Cottagers last season.

He had reached the end of his contract and visited the Nottingham Forest training ground last week.

But he said he is staying at Fulham.

“Happy to sign one more year with Fulham,” he told the club’s website.

“Happy to continue the work that I did last season with all my teammates and the whole club. I think it’s a club that can do even better this season.”

No Going Back, Ronaldo Closes Door On Return To Europe

Cristiano Ronaldo said there is no chance of him playing club football in Europe again and that the Saudi Arabian league is better than Major League Soccer, where his great rival Lionel Messi has chosen to begin the next chapter in his career.

Ronaldo, who joined Al Nassr in December on a 2-1/2 year contract following his exit from Manchester United, said he had paved the way for other top players to sign with Saudi teams and that more would make the move to the desert kingdom.

The 38-year-old Portugal captain, speaking after Al Nassr’s 5-0 loss to Celta Vigo in a pre-season friendly on Monday, said most European leagues were in decline.

“I’m 100 per cent sure I won’t return to any European club. I’m 38-years-old,” ESPN quoted him as saying.

“European football has lost a lot of quality. The only valid one and still doing good is the (English) Premier League. They’re way ahead of all the other leagues.”

Ronaldo’s long-time rival Messi was also linked with a move to Saudi Arabia before the Argentine World Cup winner completed a transfer to MLS side Inter Miami, signing a deal until 2025.

“The Saudi league is better than MLS,” Ronaldo said.

“Now all the players are coming here … In one year, more top players will come to Saudi Arabia.”

Several high-profile players have followed Ronaldo to the Saudi league, including Ballon d’Or winner Karim Benzema from Real Madrid and N’Golo Kante from Chelsea, who both joined champions Al-Ittihad.

School Director Slapped With 35-Year Jailterm For Sodomizing A Student

A Garissa court issued a landmark ruling in which a director of a private school in the county was sentenced to 35 years in prison for sodomizing a secondary school student.

Hussein Hassan Ali was found guilty of robbing the innocence of the 17-year-old boy who was a student at Mwangaza Private Primary and Secondary Schools, where he was also the principal, by Garissa Resident Magistrate Shadrack Otuke.

Garissa Resident Magistrate Shadrack Otuke said during his ruling that he was convinced by the prosecution’s evidence and sentenced the accused to 35 years in prison.

The sentencing concludes a case that has been pending since November 2021.

The victim, who was in Form 2 at the time, was later transferred to a secondary school in Malindi.

Raila Security Allegedly ‘Withdrawn’ Ahead Of Wednesday Protests

The security detail of Raila Odinga, the leader of the ODM party, has been withdrawn.

According to a police source, the withdrawal is related to the Opposition leader’s planned mass demonstrations. The security of other Azimio leaders aligned with Raila has also been withdrawn.

Wiper leader Kalonzo Musyoka, Narc Kenya leader Martha Karua, four governors, and over 50 Azimio MPs are among them.

Raila has called for three days of anti-government protests between Wednesday and Friday. The protests, which he claims will be game changers, are intended to increase pressure on the Kenya Kwanza government to reduce the cost of living. 

Odinga expressed concern on Sunday about claims that the government is plotting to harm the Azimio leaders when they lead the demonstrations this week.

“Be ready for the game-changing maandamano beginning Wednesday,” Odinga tweeted Monday evening. Tumechoka.”

Gladys Wanga of Homa Bay, James Orengo of Siaya, Prof. Anyang Nyong’o of Kisumu, and Ochilo Ayacko of Migori have all been directed by their security to report to Kisumu ahead of the countrywide three-day mass demonstrations.

Opiyo Wandayi, the minority leader, told Citizen TV that more than 50 MPs allied with Azimio had their security recalled and were ordered to report to Parliament Police Station.

Obado Back In Court As Journalist Gives Chilling Testimony

The trial of former Migori Governor Okoth Obado, his personal assistant Michael Oyamo, and Caspal Obiero in the 2018 brutal murder of Sharon Otieno and her unborn child resumed today at Milimani High Court in Nairobi.

A prosecution witness told the court how a journalist escaped from his claimed kidnappers and fled to his home for safety.

Kennedy Onyango Kasera, a taxi driver, testified before High Court judge Cecelia Githua that he was with his family on September 3, 2018 at 20:30 hours when he noticed someone entering his home.

“I heard somebody screaming… then I asked my son to open the door and we saw someone entering my house and he went straight to my bedroom…he was breathing fast…my son was afraid,” testified Kasera.

Kasera said that the journalist told him that he was kidnapped together with another lady.

“I asked him who he was and he identified himself as Barrack, and that he’s a media practitioner and said that he was kidnapped together with another lady and he managed to escape. He however did not tell me the persons who allegedly kidnapped him,” he told the court.

According to him, the journalist said that the lady had been impregnated by a governor and they were meeting with the PA (Personal Assistant).

Die-Hard Raila Fan Facing Terrorism Charges Released On Bond

A Raila staunch supporter alleged to have shared a TikTok video on Social media allegedly asking “Baba” to go to Russia and procure guns has been released on Sh500, 000 cash bail.

The prosecution and DCI believe Baba in the video clip was used to refer to ODM leader Raila Odinga.

However, the defense through Lawyer Danstan Omari has maintained It is not clear whether he referred to Raila by saying the word ‘Baba’.

The release came after Shadrack Omondi alias Omosh Jakababa spent seven days in police cells.

According to DCI, Omondi is believed to be behind a Tiktok video where he alleged that Baba should go to Russia and procure guns for his supporters to invade the state house.

Investigating officer Inspector Nickson Kinyua today informed SPM Martha Nazushi that he had completed investigations and forwarded the file to the office of the director of criminal investigations.

The prosecution, however, told the Court that they were seeking three days to peruse the evidence to know if it’s substantive to charge the suspect.

“Your honor, I confirm that we received the file today and have forwarded it to the DPP to review and know the type of charges the accused can prefer against the suspect. We are seeking for an extension of three days to come back in court”, the court was told.

Omosh through her lawyer Shanice Mutheu opposed the addition of more days to detain him arguing that investigations were already complete.

Mutheu requested the court to grant Omosh a cash bail as the DPP reviews the evidence.

Magistrate Nanzushi agreed with the application and released him on a cash bail of Sh500, 000.

The case will be mentioned on July 19.

Kinyua said Omosh was arrested in Kisumu on Monday, July 10, 2023.

According to the DCI, Omosh among other suspects still at large is said to have published through Tiktok a malicious video captioned ‘Baba enda Russia utuletee bunduki “.

“We believe that the averred publication went further to state and appear to indicate that once they acquire the purported weapons, they would be able to face off with the law enforcement officers”, the officer said.

Further, DCI told the court that the utterances by Omosh involved incitement to take up arms to advance to a protected area (State House) without permission.

In his objection through lawyer Danstan Omari, Omosh stated that DCI has not linked the Tiktok account to him hence it is hot air.

Further, he said that the word ‘Baba enda Russia’ does not disclose any offence because Russia is not a restricted country hence anybody can access it.
