Parties Tribunal Issues Stay Order Against Decision To Invalidate Kenyatta-Led Jubilee Party NDC

The Political Parties Dispute Tribunal has halted the decision of the Jubilee party’s Internal Dispute Resolution Committee to disqualify retiring President Uhuru Kenyatta’s special National Delegates Convention held on May 22.

Desma Nungo, chairman of the PPDT, stated in her ruling that any other decision made after the dispute committee’s instruction is similarly halted.

“It is hereby ordered that pending hearing and determination of the Application inter partes, interim conservatory orders are hereby issued staying the 1st Respondent’s decision dated 30th May 2023 including any decisions, actions, resolutions or pronouncements taken pursuant thereto,” said the chairperson.

The party’s internal disputes resolution committee ruled that the special NDC convened by Uhuru at Ngong Racecourse to restore order in the party null and unlawful.

The party’s internal conflict arbitrator ruled that the party leader who convened the SNDC erred because he did not follow the terms of the previous ruling party’s Constitution.

The decision came after the Registrar of Political Parties, Ann Nderitu, refused to effect the removal of many renegades expelled under the SNDC.

In a letter to beleaguered secretary general Jeremiah Kioni, Nderitu stated that the party had provided inadequate documentation to her office in order to certify the ejection of members of the splinter group led by EALA MP Kanini Kega.

“Following a review of the submitted documents,” Nderitu said in a letter to Kioni, “this office is unable to address the substance of the resolutions for non-submission of requisite documents.”
