Party Officials To Quit Posts To Take State Jobs

So far ANC leader Musalia Mudavadi and Mr. Muturi, the Democratic Party Leader has declared their move towards resignation from their party leadership to serve the Nation at different Capacities.

The law prohibits state officers from serving in political parties. This constitutional provision is set to affect Amani National Congress (ANC) leader Musalia Mudavadi, former Democratic Party National Assembly Speaker Justin Muturi, Alfred Mutua of Maendeleo Chap Chap, Moses Kuria of Chama cha Kazi, and Eliud Owalo, the United Democratic Alliance (UDA) deputy secretary general responsible for policy and strategy.

Only the President, Deputy President, and Members of Parliament are exempt from the provision because they are elected by universal suffrage.

According to the Law, a full-time state officer shall not work in any other gainful occupation. Article 77 (1), (2) of the Constitution states that “any appointed State officer shall not hold office in a political party.”

President William Ruto has appointed Mr Mudavadi as Prime Cabinet Secretary, Mr Muturi as Attorney-General, Dr Mutua as Cabinet nominee for Foreign Affairs, Mr Kuria as Trade and Industry nominee, and Mr Owalo as ICT nominee.
