Pathologists Tell Court Jeff Mwathi Was Not Sexually Assaulted

Two pathologists have told the Milimani Law court that the late Jeff Mwathi was not sexually assaulted before his death.

Retired government pathologist Dr. Peter Ndegwa and chief government pathologist Dr. Johansen Oduor both testified before Milimani Principal Magistrate Rose Ndombi on Tuesday, 21, October , 2025.

Dr. Ndegwa, who conducted the first postmortem, told the court that his examination did not reveal any signs of sexual assault.

During cross-examination by lawyer Duncan Okatch, representing musician Lawrence Njuguna alias DJ Fatxo, Dr. Ndegwa confirmed that his findings showed no indication of sexual abuse.

Dr. Oduor, who performed a second autopsy on March 31, 2023, after the body was exhumed at the request of the Directorate of Criminal Investigations (DCI), told the court that his independent analysis also found no evidence suggesting sexual assault.

Asked by lawyer Okatch whether rectal swabs collected during the procedure indicated any abuse, Dr. Oduor responded, “No.”

The defence lawyer further told the court that the burial of the deceased had proceeded without incident and that claims of sexual assault only surfaced later through social media.

He referred to an affidavit by Corporal Philip Kilonzo filed in Criminal Application No. E117 of 2023, which cited social media allegations claiming Mwathi was sexually assaulted before his death.

Musician Samuel Muchoki alias Samidoh, who testified as a witness, confirmed that the allegations were widely circulated online.

Lawyer Okatch also questioned Samidoh about his association with Senator Karen Nyamu, who had publicly commented on the case at the time. Samidoh acknowledged that they were “probably more than friends.”

The second postmortem requested by the family did not confirm any sexual assault findings.

The inquest continues on October 23, 2025, when two more witnesses, the family’s pathologist and a crime scene expert, are expected to testify.
