A man has puzzled judicial officers after appearing to welcome his four-month jail-term for stealing phones from a police officer.
Mohammed Noor had been sentenced to four months in prison for stealing two mobile phones worth Sh 30,000.
However, the convict was overwhelmed by joy claiming that the four months jail term will make him grow fat due to free food in prisons.
“Hizo miezi nne nitanona sana” said the convict as he boarded the police Landcruiser to prison.
The said phones belonged to OCS Adan Shukri of Suguta police station in Samburu County.
The court ruled that it has taken into account that the accused person is remorseful.
Accused person’s mitigation that he was used by devil to steal was also noted by the siting court.
Further, Hon Bernard Ochoi SPM noted that although there may be no criminal record for the accused, he appears to have been in crime for a long time and it emerged that his family has been covering up for him.
“The fact that he dares steal from a police vehicle using tactics to destruct the driver before stealing the phones demonstrates his experience”. Said the Magistrate.
“Taking all factors into account, the court finds the accused not suitable to a non-custodial sentence. Therefore, I will sentence him to four months imprisonment with a warning that in future if he commits another offense, he may face stiffer sentence” proceeded the Court.
