The High Court in Nairobi has rejected an application for an injunction in the Mumias Sugar Company lease case filed by Azimio coalition party leader Raila Odinga and ODM’s Kakamega Governor Candidate.
While dismissing the application, Justice Wilfrida Okwany stated that Odinga and Barasa’s involvement in the case was unnecessary.
The two leaders sought an injunction after being named in contempt of court case against Ugandan miller Sarrai Group.
Barasa was accused of authoring a series of derogatory messages on social media after the court barred Sarrai Group from operating in Mumias Sugar Company.
“On the same day that the court order was issued, a politician named Fernandes Barasa tweeted about the court order dated July 28, 2022.” Whereas, following the publication of a news article in a local newspaper, he stated, ‘As Azimio, we will announce the next cause of action after deliberation,’ “Examine court documents
He was also accused of tweeting on August 3, 2022 that the machines in Mumias would be restored by Wednesday, August 10, 2022.
“He also expressed derogatory remarks, claiming that creditors fighting for their rights were “loitering in our courts to frustrate the revival of Mumias Sugar Company,” according to the petitioner’s lawyer.
Raila was also accused by the lawyer of visiting Mumias Sugar and being shown around by Sarrai Group personnel despite a court order prohibiting the Uganda-based company from entering the sugar miller’s premises.
Odinga and Barasa were represented by the law firms of James Orengo and Jared Sala in their applications for enjoinment on Thursday.
Preliminary objections to the application have been filed by the Sarrai Group, Gakwamba Farmers, and the Wanga Council of Elders.
The matter will be heard on September 7.
