Police officer Ahmed Rashid associated with the Eastleigh extrajudicial killing will take a plea on Friday after High Court Judge Kanyi Kimondo denied his application to halt the plea-taking until a matter filed is heard and determined.
Rashid argued that he has been a police officer for nearly 22 years and that he is a law-abiding officer who has never misused his firearm.
He told the court that he had never been summoned by the Independent Policing Oversight Authority (IPOA) and learned about the case through social media.
“In the case of the 2016 incident, the two were killed in the course of a robbery, they were dangerous, and they had attacked police officers,” the court heard.
IPOA, for its part, claimed that it conducted independent investigations and recommended that the alleged killer cop be charged with murder.
However, the court stated that it cannot infringe on the independence of the Director of Public Prosecutions (DPP) and thus dismissed Rashid’s notice of motion.
Sergeant Rashid is facing murder charges in connection with the March 31, 2017 killings of two suspected thieves in Eastleigh, a murder which was caught on camera.
The Eastleigh business community, which has 24,000 members, has since urged the ODPP to drop the charges against officer Rashid, claiming he acted within the law.
