The Supreme Court denied the Nairobi City County Assembly clerk’s motion to dismiss former Nairobi Governor Mike Sonko’s appeal petition.
Sonko petitioned the Supreme Court in March 2022 to overturn the Court of Appeal’s and High Court’s decisions upholding his impeachment.
On Monday, July 11, the Supreme Court’s five-judge bench issued a decision in which they chastised Sonko’s actions while also supporting him on the grounds that they would not result in adverse orders against him.
The decision was made by a bench comprised of Lady Justice Njoki Ndung’u, Deputy Chief Justice Philomena Mwilu, Justice Wajala, Justice Lenaola, and Justice Ouko.
According to the court, Sonko violated the regulations, which require petitioners to submit consistent electronic and paper versions of their documents.
The courts also determined that the former county executive filed an appeal notification on March 8, four days after the Court of Appeal decision.
He finally filed the petition on April 4, the penultimate day he had.
