Court To Give Ruling On Sakaja’s Fate On Friday

Sakaja's Lawyers have urged the presiding Judge to dismiss the petition with cost citing that the case was filed in bad faith to block the said Senator.

Justice Anthony Mrima sitting at Milimani Law courts on Monday 4,stated that the court will issue a virtual Judgement in the matter challenging the decision by IEBC to clear Senator Sakaja as an aspirant for Nairobi County Gubernatorial seat on Friday 8.

In the case, the petitioner is seeking to set aside the decision made by the Nairobi County returning officer in clearing Hon.Johnston Sakaja to vie for the city governorship.

Sakaja’s Lawyers have urged the presiding Judge to dismiss the petition with cost citing that the case was filed in bad faith to block the said Senator.

“My lord, the petition before you is more than appropriate to have this court exercise its judicial powers and dismiss it in its entirety, ” said the Lawyers.

Further, Hon. Sakaja, through his Lawyers said that the existence of his degree was never disputed before the IEBC Disputes Resolution Committee.

“The petitioner only challenged the production of a fake and fraudulent degree. In a case where the legitimacy of an academic certificate is challenged, the burden of proof shifts to the owner of the certificate. In this case, my lord, Sakaja furnished the tribunal with graduation ceremony photos and a graduation list where his name was featured,” Sakaja said through his Lawyer.

The court retired to write its ruling, setting Friday, July 8, 2022, at 9:00 a.m. to deliver the final ruling, which is expected to either give Sakaja the green light to advance his campaign or put an end to his political career.
