Mr Samuel Atandi has had his nomination for the Alego Usonga Parliamentary seat invalidated and new elections ordered in the Orange Democratic Movement (ODM) Party Siaya primary.Â
The Political Party Dispute Tribunal (PPDT) ordered the Party’s National Elections Board (NEB) to hold a new universal suffrage nomination within 72 hours (three days).
The verdict was reached following a successful appeal by Mr Atandi’s opponent,
Dr Nicholas Ochogo, who filed a complaint with the tribunal under a certificate of urgency to have the case heard.
Dr. Ochogo named the ODM party and Samuel Atandi as the first and second respondents in the case, respectively.
Mr. Ochogo submitted his second petition after the incumbent was certified the victor of the April 13 nominations.
Mr Atandi’s victory was maintained in the first petition, which was filed at the ODM party tribunal.
The point of dispute was the result of the Alego Usonga primary, in which Mr Atandi received 17,789 votes, defeating former University don Dr Ochogo, who received 3,350 votes from the constituency’s six wards.
Professor Jackline Oduol, a nominated MP, came in third with 542 votes.
The tribunal, however, overturned Mr Atandi’s victory in a decision issued between 7 and 8 p.m. on Sunday.
