Senator Omtatah Challenges the Appointment of Police IG Douglas Kanja

Busia County Senator Okiya Omtatah has filed a lawsuit contesting the appointment of Douglas Kanja as the Inspector General of Police.

Omtatah, along with co-petitioners Eliud Karanja and Magare Gikenyi, argues that Kanja’s appointment did not adhere to the competitive recruitment process mandated by law, claiming it should be revoked by the court.

In the petition, the plaintiffs seek a court order prohibiting Kanja from performing the duties of Inspector General of the National Police Service (NPS) or from accessing relevant offices while the case is pending.

The petition lists multiple respondents, including the National Assembly, the Senate, the Attorney General, the National Police Service Commission (NPSC), and the Kenya National Commission on Human Rights (KNCHR).

Furthermore, the petitioners contend that Kanja’s appointment is unconstitutional, alleging he was unilaterally selected by the president without due process.

The High Court has deemed the matter urgent, with Justice Bahati Mwamuye ordering respondents to preserve all documents related to Kanja’s suitability and appointment.

The hearing is scheduled for October 15, 2015.
