Busia Senator Okiya Omtatah has lost a bid to have the High Court issue an order halting the rollout of the Social Health Authority (SHA), which began today, October 1, 2024.
Justice Bahati Mwamuye while declining to issue the orders, he certified the petition as urgent.
According to Justice Mwamuye, after a preliminary review of the Notice of Motion and the constitutional issues raised, he certified the application dated September 30, 2024, as urgent and direct that it be heard on a priority basis.
The Busia Senator Omtatah, alongside Eliud Matindi and Dr Magare Gikenyi, had filed the petition seeking to halt the SHA rollout and invalidate the contract between the government and the Safaricom Consortium.
The petitioners also sought the suspension and cancellation of the government’s contract with the Safaricom Consortium, which includes Safaricom Plc, Konvergenz Network Solutions, and Apeiro Limited, to provide the Integrated Healthcare Information Technology System for Universal Health Care.
The case will be mentioned on October 9, 2024 for further directions.
