Marsabit Sheikh acquitted of terrorism charges pleads with Court to order the state to continue remanding him in prison

Sheikh Guyo Gorsa Buru, who was charged with terrorism, has asked the court to allow him remain in cells after he was acquitted of the charges. 

Milimani Chief Magistrate Micheni Wendy acquitted Sheikh after the prosecution failed to prove the case against him where he was accused of collaborating with the Al-Shabaab in 2018.

Through his lawyer John Khaminwa, Buru told the court not to release him but remand him at the Kamiti Maximum Prison as he feared for his life.

. The lawyer cited recent incidences of abduction of acquitted persons after being charged with terrorism, saying that this informs his client’s fear.

“The accused is certain he will be acquitted of the offence but he fears that if he is acquitted, he will be abducted and killed by the state. We request that he remains at Kamiti Maximum Prison,” argued Khaminwa. 

However, Micheni told him to choose either to stay in jail for 30 days and pay the state for his upkeep or pursue his freedom. Buru filed a petition at the High Court seeking to compel the state to provide him with security upon his release. 

The magistrate said although she had acquitted Buru, his application to move to the High court was welcomed.

She added that Sheikh was at liberty to walk out but can opt to remain in custody as he pursues his constitutional rights.
