Rose Njeri, a software developer facing allegations under the Computer Misuse and Cybercrimes Act, has been released on a personal bond of Ksh100,000. The release comes as the court considers a legal challenge filed by her defense team questioning the legitimacy of the charges brought against her.
Njeri appeared before Magistrate Geoffrey Onsarigo at the Milimani Law Courts, where the prosecution sought to charge her with unauthorized interference with computer systems. The accusations stem from her alleged creation of a web application that sent bulk emails to the National Assembly’s Finance Committee.
However, Njeri’s defense team — led by a high-profile group of lawyers including former Chief Justice David Maraga, Dr. Stephen Kalonzo Musyoka, Makueni Senator Daniel Maanzo, Ndengwa Njiru, Eugene Wamalwa, and former Law Society of Kenya President Eric Theuri — objected to the charges. They argued that the charge sheet was fundamentally flawed and lacked a legal basis, asserting that no specific law criminalizes the alleged offense.
Justice Maraga told the court that the charges against Njeri failed to disclose any recognizable crime under current legislation.
The court agreed with the defense’s position, granting Njeri a personal bond and scheduling the next court date for June 20, 2025. At that time, the court will rule on whether Njeri will be required to take a formal plea.
