Summon Chebukati To Face Me: Wanjigi Tells Court

Presidential aspirant Jimi Wanjigi now wants IEBC chair Wafula Chebukati summoned to appear before the court for cross-examination for denying him candidature.

Wanjigi through his advocate urged the dispute resolution committee to compel Chebukati to appear before it to set records clear as to why he allowed other persons to vie without degree certificates.

“I urge this tribunal to summon Chebukati for refusing to accept my client’s papers on grounds that he had no valid degree certificate” lawyer Willis Otieno for Wanjigi urged the committee.

 “We believe the IEBC chair has crucial information which we wish to cross-examine him for a fair decision to be made by this tribunal and for the interest of justice,” said Otieno. 

However, a lawyer representing the IEBC opposed the application saying they did not receive a letter by Wanjigi to the Chair requiring him to appear before the Dispute Resolution Committee hearing on Thursday.

The lawyer told IEBC that Mr Chebukati did not receive the letter addressed to the committee by Wanjigi. 

At the same time, the committee has discharged Daystar university from the proceedings. The said University was dragged into the case by virtue of a certificate by Wanjigi purported to be from the Institution. 

The committee discharged the university from the matter following an application by its lawyer Paul Lilan who submitted to IEBC that Daystar University was not listed in Wanjigi’s case as a party. 

“Daystar University has sworn affidavit answering all the issues in question and can only participate in this proceedings if they are a party, now that we are not a party in the matter, I pray that we are discharged from the proceedings, I will withdraw my sworn affidavit from the records if need be” Said Lilan.

“Institution of higher learning should be protected from this kind of proceedings they play no role in the clearance of candidates participating in the general elections.” Proceeded Lilan.

Wanjigi is challenging the decision by Chebukati to deny him clearance to run for the presidency.
