Suspect Escapes Death Penalty After Magistrate’s Advice

Isaiah Munabi escaped a possible life imprisonment after reversing his guilty plea to robbery with violence charges.

The Milimani Magistrate Court had placed the suspect on the dock, who then rushed to plead guilty to the charges.

Aware that the suspect was unfamiliar with court processes, she moved with speed to caution the accused on the implications of pleading guilty stating that the offense carries a death penalty on conviction.

“Before you plead guilty it is good to know that the offense you are charged with carry a death penalty” said Magistrate.

The accused, shocked, recanted his plea and instead denied the charges.

He was released on a bond of ksh 200,000 with an alternative cash bail of Ksh 80,000.

According to the charge sheet, the accused had robbed Ms Vivian Awour property Worth Ksh 1000.

The crime was committed on 16th February 2022 along Link road in upper hill where the accused armed with a panga robbed the victim some shopping worth the said amount.

The case proceeds ona 3rd March 2022 for pre trial
