The nomination of Westlands MP Tim Wanyonyi has been revoked by the Political Parties Dispute Tribunal.
This comes after Michael Magero Gumo, the son of veteran politician Fred Gumo, filed a legal challenge to ODM’s nomination decision.
Wanyonyi’s certificate has also been revoked by the Tribunal.
Magero argued that he won the party’s primaries and that Wanyonyi did not participate in the process through his lawyer, Duncan Okatch.
The ODM has been given 72 hours to conduct new nominations.
Magero filed a lawsuit against the Orange Democratic Movement’s National Elections Board last week, requesting that the party not forward Wanyonyi’s name to the IEBC.
Magero demanded that ODM issue him a nomination certificate, claiming that incumbent Wanyonyi did not participate in the primaries.
Magero argued that no legal process allows ODM to issue a certificate to someone who did not participate in the nomination process.
He wants the NEB to issue a temporary restraining order to prevent Wanyonyi’s name from being gazetted.
He’s also asking for a permanent injunction barring ODM from submitting any other person’s name to the IEBC.
