Tout Who Allegedly Killed Another To Be Charged With Murder

An inquest hearing into the death of a Matatu operator at Stage four, Luthuli Mfangano Junction in Nairobi has concluded that indeed the operator was murdered by a tout in the same stage.

In the ruling delivered by Magistrate Alego at Milimani Law Courts in Nairobi, the Magistrate said that all evidence proved that Winstone Kaara, who was the person of interest in the inquest indeed murdered the deceased.

Winstone Kaara became a person of interest after being accused of assaulting Joshua Oyonde on October 14, 2021, an assault which led to his death 14 days later.

Brief circumstances of the case are that on the 14th ay of October 2021 at around 2000Hrs, at Stage Number Four, Luthuli-Mfangano junction in Nairobi town, a confrontation ensued between the deceased and the suspect one Winstone Kaara.

The deceased was then knocked down by a hand blow on the head and he went unconscious. He later woke up and proceeded home. The following day he was not feeling well and was taken to a nearby clinic and was given medication for Malaria.

The deceased stayed indoors in his house at Mukuru Kwa Reuhen Reuben while receiving medication from the said Region medical centre.

On 22/10/2021 his brother after realizing that he was not getting better, escorted him to Central police station to make a report of assaulted vide OB 173/22/10/2021 and he continued to stay at home.

On 28″ day of October 2021, he succumbed to injuries while at Kenyatta National Hospital.

“It is not in doubt that Winstone Kaara was named as the person who hit the deceased, the postmortem and the pathologist report found the injuries leading to his death. Without going into the analysis of the evidence, this Court finds that the main suspect is Winstone Kaara and that this Court recommends that he be charged for murder with the death of the late Joshua Oyonde, may Joshua Oyonde,s soul rest in eternal peace” ruled the Magistrate.

The matter was forwarded to ODPP on December 2, 2021, for perusal and advice and he directed that the same be placed before a magistrate of competent jurisdiction as an inquest for determination.

The suspect will now be charged with murder after the magistrate closed the file and directed that he be charged with murder.
