Nairobi, Kenya – June 27, 2025

A Nairobi court has released two men who were arrested over a viral social media post allegedly urging Gen Z demonstrators to storm State House.

Milimani Chief Magistrate Dolphina Alego rejected a request by the prosecution to detain the suspects for 10 more days to allow further investigations.

The two, identified as Suleiman Wanjau Bilali and Robert Otiti Elwak, were arrested in Muthurwa and Kayole respectively.

The Directorate of Criminal Investigations (DCI) linked the suspects to a widely circulated protest timetable shared from the X account @daguindd, which allegedly called on demonstrators to occupy State House.

According to investigators, the post was part of a broader plan to disrupt the recent Gen Z-led protests, which turned violent on June 25.

Authorities reported incidents of property damage, injuries to police officers, and several fatalities.

The prosecution had asked the court to grant custodial orders to allow forensic analysis of the suspects’ mobile phones, access to their bank and M-Pesa records, and recording of witness statements.

Lead investigator Sergeant Samuel Itegi argued that releasing the suspects could interfere with the investigation and endanger potential witnesses.

However, Magistrate Alego ruled that the application lacked sufficient grounds, emphasizing the constitutional right to liberty and due process.

“The right to liberty protects individuals from arbitrary detention and unlawful interference with their physical and mental integrity,” the magistrate stated, adding that arrests must be grounded in lawful procedures.

The two were released on a personal bond of Ksh 50,000 or an alternative cash bail of Ksh 20,000 each. The case will be mentioned on July 8, 2025.
