Court Detains Two Police Officers for 14 Days as IPOA Probes Fatal Shooting

Two police officers will remain in custody for 14 days after the Milimani Magistrates court allowed the Independent Policing Oversight Authority (IPOA) more time to conclude investigations into the fatal shooting of a civilian in Nairobi.

The officers, identified as Sergeant Godwin Mjomba and APC Patric Mutunga Titus, were detained following an application by IPOA seeking custodial orders to enable completion of investigations into the death of Shukri Adan Ibrahim Issaka.

In its ruling, the court held that releasing the officers at this stage could jeopardise ongoing investigations, citing their positions within the police service and the likelihood of interference with witnesses and evidence.

IPOA told the court that the officers are suspected to have been involved in the fatal shooting that occurred on January 11, 2026, near the MCC area within the Villa Police Station jurisdiction.

Preliminary investigations indicate that the deceased was shot while lying down and later succumbed to a single gunshot wound to the head.

According to court filings, IPOA investigators said the matter sparked public outrage and protests, some of which turned violent, raising additional concerns about the safety and integrity of the investigation process.

The authority further informed the court that the respondents’ mobile phones had been seized and were yet to undergo forensic examination, which it said was critical to establishing coordination, communication and possible concealment of events surrounding the incident.

IPOA also told the court that more witness statements were yet to be recorded, including from police officers stationed at Villa Police Station at the material time and that additional time was required to analyse forensic and post-mortem findings.

In allowing the application, the court ordered that the two officers be remanded at Capitol Hill Police Station for a period of 14 days to facilitate the completion of investigations without interference.

The matter is scheduled for mention on January 26, 2026, for a progress update on investigations and for further directions.
