Two Somali Minors Released on Ksh 50,000 Cash Bail in Flag Desecration Case

The case against the two minors accused of desecrating the Kenyan flag at nyayo stadium, resumed on Thursday, October 2, 2025.

During the session, the prosecution had earlier argued that the teenagers, aged 14 and 17, should remain in custody as the trial proceeded for various reasons including their safety.

However, the defense countered this by asking the court to release them to their family, assuring that they would attend all future proceedings. The defense also did not dispute the charge of desecration of the national flag.

The magistrate noted that there was an allegation the two might be in the country illegally — a matter the court described as serious, since it could affect their future attendance.

Still, the court emphasized that the law presumes them innocent until proven guilty. With their parents and relatives present and willing to guarantee their attendance, the magistrate granted release.

Each of the boys was ordered to post a cash bail of Ksh 50,000, accompanied by two sureties. “One of the sureties must be a Kenyan citizen, ” the magistrate said.

The case is scheduled to be mentioned on October 8, 2025.
