Wajir Deputy Governor Ahmed Mukhtar’s bid to continue serving as county governor was denied by the Court of Appeal.
This comes after the High Court last month overturned Governor Mohamed Abdi Mohamud’s impeachment on May 17, 2021, enabling him to return to his position.
Mukhtar has filed an appeal, claiming that the Meru High Court bench of Edward M. Muriithi, Patrick J. Otieno, and Wamae T. W. Cherere erred in law.
In his answering affidavit, Mohamud stated his argument for the right to resume office, claiming that Mukhtar’s appeal raised no debatable grounds.
“According to him (Mohamud), all that the trial court did was to restore the parties to the same position in which they were before his ‘illegal’ impeachment. He expresses his apprehension that, if stay is granted as sought, the IEBC might not clear him to vie for any political seat in the forthcoming elections.”
As a result, Judges W. Karanja, Hannah Okwengu, and K.I Laibuta ordered that Mohamud and Mukhtar keep their positions as Governor and Deputy Governor, respectively.
Governor Mohamud will now return to office on Thursday, March 10, 2022.
