DPP Haji Opposes Waluke Release

According to Walukhe's lawyers, there are 30 arguable legal points supporting the appeal's overwhelming success.

DPP has opposed an application filed by MP John Waluke to be released on bond pending the hearing of an appeal to nullify his 67 years jail-term.

The Director of Public Prosecutions, led by Alexander Muteti and Victor Awiti, has asked the Appellate Court to dismiss Sirisisa Member of Parliament John Walukhe’s bail application as hopeless.

While urging the three-judge bench to uphold the High Court and lower court decisions, Muteti stated that the Court of Appeal has no basis for overturning the lower court decision, and that the presumption of innocence has already been lost.

“Applicant was properly convicted and sentenced and is therefore serving a lawful sentence emanating from a concurrent finding of the subordinate court and the superior court,” the prosecution stated.

According to Walukhe’s lawyers, there are 30 arguable legal points supporting the appeal’s overwhelming success.

He requested that the Appellate Court release him on bail pending the outcome of his appeal so that he could continue to serve his people.
