Fredrick Barasa Wabwoba, a watchman at London beauty center pleaded guilty to various offences ranging from neglecting to prevent commission of a felony to stealing contrary to the law.
The prosecution told Court that Barasa was employed as a guard to protect London beauty center building in Nairobi, however, on the material night he was captured on CCTV cameras directing people to break stores of the building stealing laptop and other accessories valued at Ksh 942,000.
Barasa pleaded guilty telling the trial Magistrate Chief Magistrate Micheni Wendy that he had a fair deal with the thugs to give him Ksh 300,000 after the crime.
In mitigation, he said he planned the robbery with the aim of benefiting from the proceeds of crime due to intense pressure of tough economic challenges he is facing.
He told the Court that he has a child in university, secondary school and grade three, he also said that he takes care of his aged mother hence his little salary of Ksh 7,000 could not cater for the needs.
He pleaded with the Court to tamper Justice with mercy.
The magistrate however sentenced him to 6 years in prison without the option of a fine stating that Barasa was given a position of trust to secure the building but chose to corrupt the trust.
The court also noted that there is increased insecurity in Nairobi hence Barasa’s mitigation of pressure could not be used as a defense.
Hon. Micheni Wendy noted that the court ought to pass a strict sentence to serve as deterrence.
