A judge has ordered the government to pay Sh30 million to a consultancy firm for work on the feasibility study and design of the Sh98 billion Magwagwa Multipurpose Dam on the River Sondu in Nyamira that was completed 12 years ago.Â
Justice Jairus Ngaah ordered the Ministry of Water, Sanitation, and Irrigation’s Principal Secretary to pay Smec International Pty Limited $378,176 in damages (Sh30,359,207).
The money was awarded by the court in a ruling dated September 18, 2020, but the Ministry neglected to pay, causing the company to go back to court and ask for compelling orders.
On Friday, Justice Ngaah stated that because the verdict was against the government, the firm had no other means of enforcing it.
From August 16, 2012, until complete payment, the money will be paid simultaneously with interest at a rate of 2% per month.
On May 31, 2010, the firm signed a contract with the ministry.
The Lake Basin Development Authority is in charge of the development project. It is an important investment opportunity in the Western Kenya region and is part of the country’s Vision 2030 projects.
The dam and hydropower component consists of a concrete-faced rockfill that is 95 meters high and 450 meters long and will generate 120 megawatts of hydropower.
The first phase of construction would focus on providing bulk water to Magwagwa town and maintaining the current treatment facilities at Nyakach.
