The High Court has granted conservatory orders preventing the Office of the Directorate of Public Prosecutions (ODPP) from charging businessman Jimi Wanjigi.
This ruling follows Wanjigi’s appearance before a subordinate court today, where he awaited a decision on whether he should take a plea regarding charges, including possession of explosives.
Justice Bahati Mwamuye delivered the order that effectively removes the subordinate court’s authority in this matter.
The ruling stated: “…an order of prohibition be and is hereby issued against the 2nd respondent barring [the ODPP] from proffering or instituting any criminal charges or continuing any criminal prosecution against the petitioner relating to the subject matter of the petition…”
The court further clarified that Wanjigi should not take a plea during his scheduled appearance on September 26, 2024.
Wanjigi first encountered legal trouble when he was arrested and arraigned in August 2024, facing charges for possessing firearms without a license.
Since then, the case has been mired in legal limbo, with multiple court orders compelling the ODPP to refrain from proceeding with the charges.
