2 Former Embakasi South CDF Employees Convicted Of Ksh.2M Fraud

Two employees of the Embakasi South National Government Constituency Development Fund (NG-CDF) have been convicted of defrauding the Constituency Fund of ksh 2,199,823.

Peter Mukhanji and Nifrey Tero were charged with conspiracy to conduct an offence of corruption and intentional failure to comply with procurement laws.

They were convicted after the court determined that the evidence given by the prosecution proved the two had committed the acts.

Peter Mukhanji was convicted of willfully failing to comply with procurement laws.

Nifrey Musilivi on the other hand was convicted of fraudulent acquisition of public property.

They were jointly convicted of fraudulently conspiring to defraud the Embakasi South Constituency of Ksh. 2,199,823 million.

In his ruling, Milimani Chief Magistrate Hon. Victor Wakhumile noted that exhibits and testimonies presented in court by the prosecution corroborated and affirmed that the two conspired to defraud the entity.

He added that further evidence showed Peter Mukhanji stole exhibits from the court with the intention of interfering with the matter and noted that such an act showed that of a guilty mind and uncooperative individual.
