Supreme Shocker: Raila, Ruto Hold Breath

The seven Judges of the Apex Court are expected to give Judgement based on nine major issues.

Today at 12:00 noon the Supreme Court of Kenya is expected to give Judgement on a petition filed by the Azimio la Umoja Coalition leaders Raila Odinga and Martha Karua challenging the validity of declaration of William Ruto as the fifth Kenyan president-elect.

The seven Judges of the Apex Court are expected to give Judgement based on nine major issues.

Both the petitioners and the respondents’ Lawyers put on a spirited fight in an attempt to convince the Judges that indeed their clients were in the right.

Senior Counsel James Orengo and Philip Murgor told the Court that Ruto was declared president-elect without meeting the Constitutional threshold of 50%+1.

Counsel Mahat Somane defended the IEBC Chairman by stating that indeed Ruto passed the Constitutional margin by far and qualified to be declared the 2022 presidential election winner.

The seven Judges Constitutionally are at liberty of either delivering a unanimous Judgement or Judgement featuring a majority decision and a descending Judges decision.

Historically, the Former Chief Justice David Maranga introduced a system at the Apex Court where each Judge is required to write individual Judgement in relation to matters filed at the Court.

His Successor, Chief Justice Martha Koome adopted the same system upon assuming office.

It is therefore expected that the Seven Judges will approach the Court today with individual Judgment and personal legal reasons for arriving at the Judgement.

Kenyans of all walks of life eagerly waits for the Judgement which will determine whether the President-elect will be sworn in or the Country will prepare for another election within 60 days as it was the case in 2017.
