According to the DPP, former TV presenter Jacque Maribe plotted the murder of late businesswoman Monica Kimani with her former fiancé Joseph Irungu aka Jowie.
The prosecution has requested the court in their submissions to declare both Maribe and Jowie responsible for Monica’s death.
After hearing testimony from 35 witnesses and weighing submissions from the state, Jowie, and Maribe, the court will rule on whether they will be placed on trial or acquitted.
According to Assistant DPP Gikui Gichuhi, all of the circumstances leading up to the murder, as well as Maribe’s subsequent claims to the police, suggest that she plotted to murder Monica with Jowie.
“This alludes to a calculated mind that plotted ahead with Jowie to ensure the deceased’s murder,” Gichuhi argues.
According to Gichuhi, Maribe and Jowie were the primary perpetrators who shared a single goal and worked together to destroy the deceased.
She relied on a court of appeals decision that said that aiding and abetting often entails assisting in the commission of a crime or being an accomplice.
“It is not essential that the aider and abettor knew the particular crime that was intended and which was actually committed, as long as he was aware that a crime, including the one actually committed, would probably be committed,” the submissions read in part.
The state has also asked the court to examine the fact that Maribe made no move to distance herself from Jowie’s acts and instead assisted him in destroying evidence.
“The demeanor of Jowie and Maribe should also be taken into consideration during investigations, which included submitting false information to the police, to during the trial, when the accused in certain cases ignored court hearings or did not comply with bail conditions given,” Gichuhi alleged.
