The Nyamira High Court confirmed county governor Amos Nyaribo’s win, claiming a lack of adequate evidence to overturn his victory.

Dennis Ayiera, a voter, had gone to court to dispute Nyaribo’s victory, claiming serious irregularities.

On Thursday, however, Judge Kimondo Kanyi concluded that the elections were free, fair, and in conformity with the Constitution.

The judge ruled that the petitioner had failed to present facts beyond a reasonable doubt that would justify overturning Nyaribo’s victory.

According to the judge, the Nyamira gubernatorial election was not perfect, just like any other election.

He did add, however, that the irregularities revealed did not satisfy the bar to reverse Nyaribo’s victory.

“The sum of any abnormalities could not impact the outcome of the elections since no election is flawless,” Judge Kimondo stated.

Ayiera also failed to establish beyond reasonable doubt that IEBC and the Governor committed any misconduct of any criminal kind.

The petitioner claimed in his affidavit that Nyaribo’s election was not held in line with the law and that the IEBC did not hold a free, fair, and transparent election.

“IEBC maintained that the election was conducted in accordance with the Constitution and in accordance with the law and hence the petition is hereby dismissed with costs,” Justice Kimondo said.
