Anti-Corruption Court Declines To Drop Lenolkulal Case

The Milimani Anti-Corruption Court declined an application to withdraw the Ksh 80.7 million graft case against former Samburu Governor Moses Lenolkulal and others, directing the ODPP to file a formal application.

The court, through Magistrate Thomas Nzioki, also ordered that all parties be served and that an ODPP consent letter regarding the withdrawal be presented in court.

The Ethics and Anti-Corruption Commission (EACC) is suing the county boss for Ksh.80.7 million.

The petition was filed in September 2019 by EACC on the grounds that Oryx Service Station, a company allegedly registered in the governor’s name, received Ksh. 80.7 million in county funds between 2013 and 2018.

“Prior to the institution of the suit, the commission froze Ksh.14 million and properties in Karen, Nairobi purchased for Ksh.60 million that were determined to have been purchased with funds from the illegal contracts founded on conflict of interest,” according to EACC.

The trial Magistrate also temporarily released Lenolkulal’s passport.

This comes after Lenolkulal filed an application for the release of his passport, stating that he is scheduled to travel on November 4th and return on November 12th, 2022, to attend his studies at Strathmore University.

He also mentioned that it was an internal module.
In his request, the former Samburu County boss stated that he needed the passport from October 12th to November 20th, 2022.
