Arror, Kimwarer Dam Scandal File ‘Missing’

A court file in the Ksh21 billion Arror and Kimwarer dams scam has gone missing.

On Monday, the case came to a halt after it was discovered that the documents in which former Treasury Cabinet Secretary Henry Rotich appealed his indictment in the dams scam could not be located.

Judge Anthony Mrima asked the parties to give the court more time to locate a file that was critical to the ongoing trial.

The file could not be traced at the registration, according to Rotich, the Director of Public Prosecutions and the Ethics and Anti-Corruption Commission.

While efforts to recover the file were underway, Justice Mrima announced a break, however, the file was not traced at the register during the break.

The judge instructed the parties to appear before the Deputy Registrar of the High Court once the file was retrieved.
He further claimed that after the file is located, they will be given additional instructions on how to proceed with the case.

Rotich wants the High Court to overturn DPP Haji’s decision to charge him in the dams scandals at Kimwarer and Arror.

A magistrate court dropped two charges against Rotich on Thursday, July 15, giving him a big victory in the Arror and Kimwarer dams case.
