Evans Kidero, the former Nairobi Governor, has won big after a court ordered the IEBC to turn over key election data and materials for scrutiny in his case against Gladys Wanga’s election as Homa Bay Governor.
The IEBC and county returning officer Fredrick Apopa have been ordered by Homa Bay High Court Judge Justice Roselyne Aburili to provide all kiems kits used for scrutiny.
“It is hereby ordered that the first and second respondents (IEBC and returning officer) be and are hereby directed to avail themselves to court for the purposes of the scrutiny and recount of the Kenya Integrated Election Management System kits,” the order states.
The IEBC has also been ordered to provide the court with the Secure Digital cards used in the gadgets in its custody.
For the first time, the Commission did not use a hard copy register or a manual system to identify voters, as in previous polls.
The court also ordered the Wafula Chebukati-led commission to provide all original polling station diaries for the polling stations where Kidero claims massive vote manipulation occurred.
According to the order, the court will compare serial numbers on seals and in polling diaries and compare them to copies already filed in court.
