Nairobi car dealer Khalif Kairo has been acquitted of two fraud cases after refunding Sh5.9 million to his customers, following a settlement confirmed at the Milimani Law Courts.

Kairo’s lawyer, David Makau, told the court that the final balance of Sh13,000 had been settled through the complainants’ advocate, Effie Achieng. He also confirmed that the receipt for Sh1 million bail had been handed over to the complainants to enable them to collect the amount.

Ms. Achieng, representing one complainant, confirmed receipt of the funds and acknowledged seeing the original receipt. She informed the court that her clients were satisfied with the settlement and had agreed to withdraw the matter.

In his ruling, the Chief Magistrate ordered the withdrawal of the conflict against the accused and declared that Kairo was accordingly acquitted of the charges under Section 204 of the Criminal Procedure Code.

The court also directed that the Sh1 million cash bail be released to the complainants.

However, the magistrate ruled that the release of Kairo’s passport shall await the conclusion of another pending criminal case against him.

Kairo was charged earlier this year with obtaining money by false pretences after allegedly receiving funds from clients without delivering the promised vehicles. A case that has drawn attention due to his public profile and growing online following.
