The long awaited hearing of a Murder case where businessman Chris Obure and his bodyguard Robert Ouko are charged with the gruesome murder of their business partner.

The trial Judge said that he was bereaved and therefore prayed for an adjournment.

In the case, Businessman Chris Obure together with his bodyguard Robert Ouko are charged with the murder of Kelvin Omwenga at Kilimani.

The two have so far denied having murdered Kelvin and are out on bail. They were accused of jointly killing Omwenga on August 21, 2020, at Galana suites in Nairobi’s Kilimani area.

Earlier on Chris Obure had applied to be turned into a prosecution witness, he said that he would serve better as a state witness than an accused person.

He argued that his intended prosecution and criminal proceedings are malicious, scandalous unlawful, unconstitutional and an abuse of the court process.

He wanted the court to quash the decision by the ODPP to charge him with the offense of murder.

The prosecution in rebuttal maintained that Obure’s gun was used to gruesomely execute Kelvin Omwenga and it was therefore unreasonable that he would be excused from criminal liability. They further said that Obure was spotted near Omwenga’s house on the fateful day.

The court in its ruling revoked Obure’s application by stating that it lacked merit.
The case has been slated for hearing on November 25, 26, and 27, 2022.
