Chief Justice Martha Koome has appointed the judges and magistrates who will preside over the swearing-in of the governors-elect and deputy governors-elect.
In a letter dated August 8, Koome stated that the appointment was made in accordance with the Assumption of Office of Governor Act, 2019.
“In that regard, I hereby appoint the Judges as per the schedule to conduct the swearing-in ceremony upon election and gazettement by the Independent Electoral and Boundaries Commission (IEBC),” the letter reads.
Some of the judges who will preside over the swearing-in ceremony are: Lady Justices Aburili (Nairobi), Rachael Ngetich (Garissa, Dora Chepkwony (Kakamega), Lucy Njuguna, David Majanja (Machakos), William Musyoka (Kisumu), Weldon Korir (Nakuru), James Wakiaga (Nyeri), Lady Justice Stella Mutuku (Kiambu), Justice Robert Limo (Makueni), Justice Daniel Ogembo (Wajir) and Lady Justice Olga Sewe (Kwale).
Justice George Dulu and Honorable Martha Mutuku will conduct the process in Mombasa County even though its election is scheduled for August 23.
In Kilifi County, Lady Justice Margaret Mwangi and Honorable Dennis Mtutu will oversee the handing over, while in Tana River, it will be overseen by Justice John Onyiego and Honorable Leah Waigera.
Justice Richard Mwongo and Honorable Lucy Mutai will swear in Isiolo Governor-elect and his deputy.
The law requires the Governor-elect to be sworn in before a High Court Judge in a public ceremony.
The county governor-elect should be sworn in on the first Thursday following the tenth day after the IEBC declares the final results of the county governor election.
“The Governor-elect shall, during the swearing-in ceremony, take and subscribe to the oath or affirmation of office as prescribed in the First Schedule section of the Assumption of the Office of Governor Act 2019. The oath or affirmation shall take place not earlier than 10.00 am and not later than 2.00 pm,” the law states.
The Governor shall sign a certificate of inauguration in the presence of the High Court Judge who conducts the swearing-in ceremony after taking or subscribing to the oath or affirmation.
