Cop Busted With Fake Case Withdrawal Letter

A police officer has been charged with allegedly forging a case withdrawal letter seeking the custody of a minor.

Daniel Nzusyo Mutiny, who has been dragged along the corridors of Justice by his wife, was charged that on January 10, 2019, at Dandora Police station within Nairobi, forged the signature of Josephine Mutindi Kithu, a complainant at the said police station, on purported withdrawal letter which was presented before Milimani Children’s Court as documentary evidence.

In the letter, Mutisya intended to mislead the Court that his wife had consented to withdraw the child support case, a fact he knew to be false.

Appearing before Milimani Chief Magistrate Micheni Wendy, the accused denied the particulars of the charges.

His defence lawyer pleaded with the court to release him on reasonable cash bail.

“Am praying that the bail term should be appropriate, indeed your honour, importance should be given to the liberty of the accused, he has to be presumed innocent, he has already been interdicted, he has no intention of absconding any court attendance, there must be a balance and this court should accord the family of the accused person a chance to secure his liberty” prayed the defence counsel.

The state did not object to the release of the police officer on bond.

He was released on a bond of Ksh 200,000 with an alternative cash bail of Ksh 100,000.
