Court Reduces Freeze Order For Pastor Ezekiel Accounts

Win for Pastor Ezekiel Odero as Milimani Chief Magistrate Court rules that the order freezing his bank accounts for 30 days violated the Law.

The 30 days freeze order were reduced to 14 after the Chief Magistrate court ruled that a Higher Cour’s ruling had clearly set out the maximum number of days a Magistrate court can order to freeze bank accounts in a criminal case.

“According to the Law, the ODPP can only freeze the bank accounts to a maximum of 14 days.” Ruled Magistrate Ekhubi.

Magistrate Benmark Ekhubi has said the orders will lapse on Sunday but since it’s a weekend, he will extend them to Monday.

“I will direct that you come back on Monday since the orders expire on a Sunday. I will extend the orders to Monday,” directed the court.

The matter will be mentioned on Monday for further directions.

In his ruling today, the magistrate said he was within the law to grant police orders to freeze those accounts.
