The Milimani Law Court has referred the incitement case against Mumias East Member of Parliament Peter Salasya to the National Cohesion and Integration Commission (NCIC) for review.
The court heard that the application to have the case referred to the commission was made by the accused, through his lawyer.
State counsel informed trial magistrate Erick Mutai that the Director of Public Prosecutions (DPP) had no objection to the referral. The court directed that the matter be mentioned on November 11, 2025, for further directions.
The magistrate further noted that should there be no progress from the NCIC by the mentioned date, the case would proceed to a full hearing.
Salasya was charged on May 19, 2025, with incitement to violence for allegedly making inflammatory social media posts that prosecutors say were intended to fuel ethnic tension between the Luhya and Luo communities.
According to the charge sheet, he allegedly wrote, “Luos are number one enemies of Luhya people… ama tuwatahiri iishe,” remarks which the prosecution described as likely to incite ethnic hatred.
He remains out on a Ksh 200,000 cash bail pending further proceedings.
