A 5 bench judge in the high court of Kenya Nairobi has faulted President Uhuru Kenyatta’s decision to withhold the names of 41 nominee judges.
The nominees were presented to Uhuru in September 2019 for an appointment by judicial Service Commission (JSC).
The nominees were to be appointed to Court of Appeal, Environment and lands court and Employment and relations court.

In the ruling the courts declared that the president has no power, right and privilege to refuse to second the JSC decision in nominating the judges terming the decision as a flagrant violation of the constitution.
The stalemate has been at the core of a blame game between the executive and the judiciary, hence frequent exchanges between Uhuru and chief justice Maraga.
The chief justice has often accused the executive of undermining the Judiciary through budget cuts and refusal of the president to appoint the nominees.
On the other hand the executive through president Uhuru has accused the judiciary of not doing enough to help in the fight against corruption, perceiving to be aiding powerful individuals with corruption cases to scot free.
