Court Sets May 4 Mention Date in JILK Sexual Assault Case Against Diageo

A Nairobi court has directed that the case involving JILK Construction Company Limited and Diageo PLC be mentioned on May 4, 2026, for parties to confirm compliance with court directions.

The case is before Chief Magistrate Geoffrey Onsarigo, who is overseeing proceedings involving allegations raised by JILK against individuals linked to Diageo.

During earlier proceedings, the court had been informed that East African Breweries Limited (EABL), a subsidiary of Diageo, had not been fully served with all documents, an issue that has contributed to delays in moving the case forward.

The dispute stems from a construction contract between JILK and Kenya Breweries Limited (KBL) for a brewery project in Kisumu between 2016 and 2017.

At the centre of the case are allegations by JILK seeking to privately prosecute two foreign nationals—Brendan Daly and Nicholas Quarke—who were overseeing the project at the time. They are accused of allegedly sexually harassing two female employees during the course of the project.

The application for private prosecution has faced opposition from the defence, including lawyer Cecil Miller, who challenged both the process and procedural aspects of the case.

With the new directions issued, the court is expected to assess whether all parties have complied with filing and service requirements when the matter comes up on May 4, a step that will determine how the case proceeds moving forward.
