Court Upholds Order Against Vaccination Certificate

An order barring the Government from implementing their directives on compulsory COVID-19 certificate is still in force, a Nairobi court has ruled.

Justice Antony Mrima consolidated all the five cases filed in the Court challenging the state order to require unvaccinated persons from accessing services in all public government entities.

The Lawyer has declined to address the issue raised by Justice Harrison Kinyanjui over the implementation of the government directive on Malls and Supermarkets.  

He also objected to comment on whether CS Health, Mutahi Kagwe should be cited for contempt of court or not.

This was after Kinyanjui raised the issue that clients and customers are being denied access to Supermarkets and other shopping centres including public facilities in compliance with an order issued by Mutahi.

Kinyanjui proceeded to accuse Mutahi of misleading his deputy Dr Mercy Mwangangi by instructing her to enforce the directive even though it was known to both that there was a Court Order blocking the implementation of the directive.

On 14 December 2021, Lawyer Antony Mrima restrained the Government from enforcing the directive demanding every Kenyan to receive the Vaccine on or before 21 December 2021.

The case has been slated for hearing on 1st February 2022.
