The hearing of a case where the Nandi Senator, Samson Cherargei, is charged with ethnic contempt entered day three today.
The prosecution side approached the court armed with four witnesses and prepared to convince the court beyond any reasonable doubt that indeed, what Senator Cherargei uttered in a public rally within Nandi County in the year 2019 amounted to incitement.
Corporal Mercy, a DCI officer who has been in police service for 23 years, told the court that she received instructions to translate utterances made by Senator Cherargei into English, Swahili, and Kalenjin.
She proceeded to say that she was required to transcribe the contents of the utterances, a duty she diligently undertook.
Asked whether utterances made by the senator could mean incitement she confirmed the part where the senator alludes to be profiling their political rivals.
For two consecutive hearing days, Senator Cherargei appears to be submitting to the rule of Law by maintaining calm in court.
This comes after Chief Magistrate Micheni Wendy of Milimani Law Courts directed DCI to probe the Senator and ascertain grounds for charging him with contempt of court.
The case proceeds tomorrow.
