Court Awards Itumbi Ksh. 630,000 For Wrongful Dismissal

The Employment and Labor Court has awarded Dennis Itumbi Kesh 631,400 compensation for his illegal dismissal from State House in 2020.

Itumbi sued the Public Service Commission (PSC), the former State House controller, the former Interior Cabinet Secretary, and the former Attorney General in the case heard by Judge Jacob Gakeri.

He stated that in a letter dated July 9, 2014, he was offered the post of Senior Director, Digital, Innovative, and Diaspora Communication, Job Group T, for a three-year term beginning July 2, 2014.

The agreed-upon beginning pay of Kshs.213,640 was paid till July 2, 2015. It was later raised to Kshs.232,960 till July 1, 2016.

On July 1, 2017, he received another raise and began earning Kshs.254,000.

“Itumbi avers he accepted the job and executed his duties professionally and fastidiously,” court documents stated.

According to court documents, the former State House controller told Itumbi that his contract had been extended to another 6-year for certified experience, raising his monthly income to Kshs.302,980.

Itumbi’s contract was then extended for another three years on May 15, 2018, with a monthly pay of Kshs.315,700.

During the COVID-19 Pandemic in March 2020, Itumbi was notified that his position had been terminated “due to termination of the office following a re-organization of Government.”

Judge Gakeri found that the firing was unconstitutional and that he be granted Ksh.631,400 total of 2 months salary.

Judge Gakeri further stated that Itumbi worked for the government for approximately 5 years and 8 months and had no warning letter or disciplinary issue previous to his dismissal.
