Dialogue Committee Files Response On Petition Challenging The Talks

The National Dialogue Committee has filed a reply to a case in which three activists have challenged the committee.

According to an affidavit signed by the delegation’s leader, Kalonzo Musyoka, the petition is speculative, incompetent, and unjustified.

According to Kalonzo, the petition is a misuse of the legal process, and the court should not give any of the requested orders.

According to Kalonzo, the petitioners are just attempting to disrupt an ongoing parliamentary process and prevent parliament from carrying out its constitutional mandate.

Kalonzo has dismissed the allegations that the committee is misusing public funds arguing that no audit has been provided by the petitioners to demonstrate misuse or wastage of any public funds and resources as alleged.

“Public interests outweigh the petitioner’s private interests and the public interests tilt in favor of the respondents,” reads court papers

Kalonzo has asked the court to dismiss the petition.

The three petitioners moved to court to challenge the ongoing bi-partisan talks being undertaken by the National Dialogue Committee (NDC), claiming that the entire process is unconstitutional.

The petitioners argue that there was no public participation in the establishment of the committee, adding that the dialogue process happening at Bomas of Kenya is majorly dominated by the political elite who want to push for constitutional reforms to satisfy their political interests.
