DPP: Why I Dropped Sarah Cohen Murder Charges

The DPP has recommended the Tob Cohen murder case go into inquest to provide an opportunity for witness testimony, and clarity of issues.

According to the DPP, prosecutors reviewed the file and directed the investigating team to cover 35 areas of investigation, which to date have not been covered.

DPP also noted that the statements recorded by the police indicate that several officers in civilian clothes visited the compound of the late Tob Cohen, and the identity of the said officers remains undisclosed.

Further, the DPP earlier on directed that Mr Mugwai, sub-county police commander Gigiri, be interrogated on his interaction and relationship with Sarah Wairimu, but that was never done to date.

Haji led office also noted that the alleged forgery of the transfer of shares belonging to Cohen was never exhausted, thus raising questions about who may have perpetrated the crime.

DPP further submitted that all the document examiners who may have authored reports touching on the wills and the forgery allegations of the transfer of shares need to record statements and unveil their respective reports.

Notably, the DPP notes that the reports are conflicting, therefore a need to have the disparities in their reports fully explained.

Telephone data of all the Police officers and any other persons of interest who may have come into contact with the alleged suspect at the time remains incomplete, yet such evidence may shed light into the planning and execution of the murder.

Haji also noted that the recent withdrawal of the affidavit by Mr Gachomo John of DCI dealt a fatal blow to the case. Moreover, it raised serious concerns about the integrity of the whole process of investigations.

ODPP further said that the Office is aware that there are allegations of several wills allegedly made by the late Tob Cohen, which also need to be examined and relevant reports submitted to the DPP for further advice.

As a result, the DPP proposed that a public inquest be held with the aim of uncovering the persons behind the gruesome murder of the late Tob Cohen.

DPP was of the view that a public inquest provides a platform for any person with information that may be useful to unravel the murder to avail that information through a judicial process.
