Tears of anguish as a convicted father pleads with court to give him a second chance in life to go home and take care of his children.
Gibson Mudachi Nyabera, a convict whose freedom now lies in the Judicial hands of Magistrate Benmark Ekhubi at Milimani Law Courts in Nairobi, could not prevent himself from shedding tears before the court.
Gibson said that he remembers the suffering his children have been going through from the day prison door welcomed their father pending the hearing and determination of a criminal charge he has been facing since the 26th day of July 2017.
“During the eight years your honour my business collapsed, my marriage collapsed, I have not seen my kids for all those years after the case started. Even if is a lesson I can tell you for free I have learnt it. I pray that you give me a second chance in life atlist to be able to save my kids…” Said Gibson in mitigation.
He said that he needs a second chance in life so that he can be able to take care of all the siblings his mother left when she died.
Gibson was charged in 2017 with the offence of acquiring uncustomed goods.
The prosecution alleged that he acquired uncustomed used Toyota Land Cruiser motor vehicle with a duty amounting to Ksh 642,000.
He denied the charges and after the hearing of the case, the court ruled that it was satisfied that the prosecution had proved their case against the accused beyond reasonable doubt.
He was convicted and the court is expected to issue a sentencing against the convict tomorrow.
