Blow To Fraud Suspect As EACC Granted Access To Video Evidence

The High Court has dismissed a Petition filed by a fraud suspect seeking to block Ethics and Anti-Corruption Commission from tabling video evidence against him.

Evans Cheruiyot,the suspect, requested the Court to prohibit EACC from relying on audio and video evidence secretly recorded secretly which squarely pins him to the fraud charges against him.

Mr. Evans Cheruiyot had urged the High Court to declare that the recording of private communications between him and the EACC Investigator, without his consent or judicial authorization, violated his constitutional right to privacy, the Data Protection Act and other laws.

In dismissing the application by the suspect,Justice Esther Maina found that there is no law that creates a mandatory obligation for EACC to issue a notice to a suspect prior to investigations in respect of corruption, bribery or any other economic crimes.
