The Ethics and Anti-Corruption Commission (EACC) has filed a lawsuit against a former telephone operator for late President Daniel Arap Moi in Karbanet town for alleged land fraud.
Ms. Pauline Chepkorir Maiyo, a former government employee, is accused of conspiring with former Commissioner of Lands Sammy Silas Komen Mwaita to illegally and irregularly allot her the Ksh.10 million piece of land.
According to court records, the allegedly stolen land in Kabarnet Municipality of Baringo County, a few meters from Rift Valley Hills Resort, had been planned, reserved, and used for Government houses.
“On 2nd August 2002, the suit property measuring 0.3518 hectares (0.869316732 acres) was illegally and/or irregularly alienated to Paulina Chepkorir Maiyo who is former telephone operator deployed to Late President Moi’s Kabarak home despite the fact that the suit property was planned and set aside for use as a public utility reserved for Government housing,” Indicated the EACC documents.
Pursuant to the court records, the defendants also failed to voluntarily return the land to the government as required by the Commission.
EACC now requests that the court rule that the allotment and transfer of the parcel of land known as Kabarnet Municipality/161 to Pauline Chepkorir Maiyo was unlawful, null and void.
The Commission is also requesting that all records pertaining to the issuance of a lease in favor of Maiyo over the land be cancelled.
